Hearing on writ petitions against dissolution of House continues

Kathmandu, 23 December (2020) - The hearing on writ petitions against the dissolution of House of Representatives continues at the Supreme Court of Nepal.

The single bench of Chief Justice Cholendra Shumsher JB Rana is hearing different writs against the dissolution.

Claiming that the dissolution is unconstitutional, parliamentarians and advocates had separately filed writ petitions at the Supreme Court on Monday and Tuesday.

President Bidya Devi Bhandari had dissolved the parliament and announced the dates of fresh elections on Sunday on the recommendation of the Council of Ministers.

Senior Advocate and former Chairman of Nepal Bar Association Shambhu Thapa requested the bench to issue interim order to nullify the President's letter to terminate the House. He also asked to send the writ against dissolution of House to full bench.

Thapa claimed that PM KP Sharma Oli is not in minority position in the parliament and there is no reason to call fresh elections when the PM enjoys support of full majority. He also said that disbanding of House is unconstitutional.

One of the writ petitioners Senior Advocate Dinesh Tripathi said the constitution has not foreseen the dissolution of House when the PM has majority support. He also argued that PM Oli does not intend to conduct elections.

Advocate Kanchan Krishna Neupane said that the Supreme Court needs to rescue the country from constitutional crisis caused by the dissolution of House.

To avoid crowd in the bench, the arguments have been arranged to watch from the Nepal Bar Association hall.
