Constitutional expert Acharya says- PM absolutely can't dissolve parliament
Kathmandu, 17 January (2021) - Constitutional expert and Senior Advocate Dr. Bhimarjun Acharya said that the prime minister with majority support absolutely cannot dissolve the House of Representatives (HoR).
While presenting his arguments at the constitutional bench on Sunday, Acharya said that the PM has flouted constitutional norms in the pretext of political question.
"The PM with majority support can't even utter the word dissolution. The unconstitutional move to disband the parliament is given a cover of political question," he said.
"PM KP Sharma Oli says that he has no interest besides prosperous Nepal, happy Nepali but how can people be happy when the PM takes unconstitutional move?" he asked.
Hearing has been taking place in the Constitutional Bench continuously from today on the writ petitions registered at the Supreme Court against the dissolution of the HoR.
The bench is comprised of Chief Justice Cholendra Shumsher JB Rana and Justices Bishwombhar Prasad Shrestha, Anil Kumar Sinha, Sapana Malla and Tej Bahadur KC.
